WARRANTY STATEMENT
This warranty is limited to Products purchased from authorized sellers in Canada. To obtain information on warranty service in Canada or to request warranty service for your Product, refer to the Warranty Center listing that was provided with your Product or visit our website, paslode.ca. To obtain service under this warranty, upon ITW Canada’s request, you must return defective Products or provide photos of the Product and the project in which failure occurred (if applicable) and provide proof of purchase from the seller at which the Products were bought.
Except where prohibited by applicable law (which may include the Province of Quebec), this warranty applies only to the original purchaser of the Product and is not transferrable.
Because ITW Canada cannot control the quality of Products sold by unauthorized sellers, this warranty applies only to Products that were purchased from ITW Canada or an authorized seller of Products in Canada, unless otherwise prohibited by law. ITW Canada reserves the right to reject warranty claims from purchasers for Products purchased from unauthorized sellers, including unauthorized Internet sites.
ITW Canada’s sole liability hereunder will be to, at its option, repair or replace any Product or Product part which proves to be defective within the specific time period. Any repair or replacement Product or Product part provided in accordance with this warranty will carry a warranty for the balance of the period of warranty applicable to the part it replaces or such longer period as may be required by applicable law. This warranty does not apply to Product or Product part replacement required due to normal wear. ITW Canada reserves the right, in its sole discretion, to refund the money actually paid by you for the Product. If the Product or component is no longer available, replacement may be made with a similar product of equal or greater value, at ITW Canada’s sole discretion. This is your sole and exclusive remedy for breach of this limited warranty.
This warranty is void as to any Product which has been subjected to misuse, abuse, accidental or intentional damage; use with fasteners, fuel, batteries, or battery chargers not meeting ITW Canada specifications, size, or quality; improper maintenance; repair with other than genuine Paslode replacement parts; damage in transit or handling; or which, in ITW Canada’s opinion, has been altered or repaired in a way that affects or detracts from the performance of the Product.
ITW CANADA DISCLAIMS ALL WARRANTIES AND CONDITIONS, EXPRESSED OR IMPLIED, RELATING TO MERCHANTABILITY, FITNESS, OR OTHERWISE, EXCEPT AS STATED ABOVE, and ITW Canada’s liability AS STATED ABOVE AND AS ASSUMED ABOVE is in lieu of all other warranties and conditions arising out of, or in connection with, the use and performance of the Product, except to the extent otherwise provided by applicable law (which may include the Province of Quebec). To the extent that applicable law (which may include the Province of Quebec) prohibits the exclusion of implied warranties or conditions, the duration of any applicable implied warranty or condition is limited to the period specified for the express warranty above. Some jurisdictions (which may include the Province of Quebec) do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. Any oral or written description of the Product is for the sole purpose of identifying it and shall not be construed as an express warranty.
ITW CANADA SHALL IN NO EVENT BE LIABLE FOR ANY DIRECT, INDIRECT, OR CONSEQUENTIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES WHICH MAY ARISE FROM LOSS OF ANTICIPATED PROFITS OR PRODUCTION, SPOILAGE OF MATERIALS, INCREASED COST OF OPERATION, OR OTHERWISE.
Some jurisdictions (which may include the Province of Quebec) do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. Where any term of this warranty is prohibited by such laws, it shall be null and void, but the remainder of the warranty shall remain in effect. This warranty gives you specific legal rights, and you may also have other rights, which vary from jurisdiction to jurisdiction. The disclaimers, exclusions, and limitations of liability under this warranty will not apply to the extent prohibited by applicable law (which may include the Province of Quebec).
ITW Canada reserves the right to change specifications, equipment, or designs at any time without notice and without incurring obligation.
